Owner Information

Sales & Rental Terms for Property Owners

These draft terms explain the commercial framework used by At Your Property when an owner submits a property for sale or rent through our platform.

Important: This is a commercial draft for website use and discussion. It is not a substitute for legal advice. Before these terms are used as a binding agreement, the final wording should be reviewed and approved by a qualified lawyer in Thailand.

1. Property Listing & Marketing

By submitting a property, the owner confirms that the information supplied is accurate to the best of their knowledge and that they are authorized to offer the property for sale or rent. At Your Property may publish the listing, photographs, descriptions, location information and other approved marketing material on its website and through its marketing channels.

2. Sales Commission

The standard sales commission for a property listed for sale is 5% of the agreed sale price + applicable VAT, unless a different commission is expressly agreed in writing.

Commission payment schedule

Unless otherwise agreed in writing, 25% of the agreed sales commission becomes payable upon receipt of the buyer's agreed deposit. The remaining 75% becomes payable upon completion of the sale/transfer.

The buyer's deposit remains payable to and for the benefit of the seller in accordance with the sale agreement. The commission payment to At Your Property is a separate obligation and is not intended to reduce the seller's agreed deposit.

3. Rental Commission

For rental listings, the owner rental commission is currently 0%. A configurable guest service fee may apply to bookings. The public website displays the guest's complete rental price as one total and does not show the service fee as a separate line.

The exact rental commission and its payment timing should be confirmed in the owner agreement for the individual property and rental transaction.

4. VAT

VAT may be applied to At Your Property's commission if VAT is activated and legally applicable. The applicable VAT rate will be shown in the relevant agreement or invoice. The website may use a simple VAT ON / VAT OFF setting for administrative purposes.

5. Non-Commission Listings

Owners / providers may submit a rental listing with 0% owner rental commission under the current platform model. Listings with an agreed commission may receive preferential placement in search results and marketing campaigns, subject to demand, availability, listing quality and At Your Property's marketing priorities. No guaranteed search position is promised.

6. Accuracy, Documents & Authority

The owner is responsible for the accuracy of property information, ownership information, pricing, availability and documents supplied to At Your Property. At Your Property may request supporting documents or clarification before publishing or promoting a listing.

7. Buyer / Tenant Introductions

Where At Your Property introduces a prospective buyer or tenant to the owner or property, the parties should record the introduction and transaction details. Any protection period, non-circumvention obligation or post-termination commission entitlement must be stated in the final owner agreement and should be reviewed under Thai law before use.

8. Deposits, Contracts & Completion

Buyer or tenant deposits, reservation payments and other transaction payments are governed by the applicable sale, reservation or rental agreement. At Your Property is not presumed to have authority to receive transaction payments on behalf of an owner unless that authority is expressly agreed. Thai Civil and Commercial Code Section 849 provides that a broker is presumed not to have authority to receive payments or other performance on behalf of the parties.

9. Listing Changes & Withdrawal

The owner should promptly notify At Your Property of changes to price, availability, ownership, rental conditions or other material information. At Your Property may suspend or remove a listing where information is inaccurate, incomplete, misleading or no longer authorized.

10. Final Agreement

These website terms are intended to explain the commercial framework. The binding obligations for an individual transaction should be contained in the final owner agreement and, where appropriate, the relevant sale, rental or reservation agreement.

11. Governing Law

The final agreement should specify the applicable law and jurisdiction in Thailand and should be reviewed for the particular transaction.

Legal review recommended: Thai law treats brokerage remuneration and its timing as matters that can depend on the brokerage agreement and the conclusion or conditions of the underlying transaction. The final commission and payment clauses should therefore be reviewed before publication as binding terms.

A draft owner agreement will be provided as a PDF for review. The PDF is a template and must be legally reviewed and adapted before being used as a signed contract.
